With Congress often unable to pass legislation tackling pressing issues and presidents frequently taking sweeping executive actions to advance their agendas, advocates at both ends of the political spectrum are increasingly turning to the courts to achieve or block federal policies. Nationwide injunctions, forum-shopping and the ability of litigants to direct their cases to specific judges may be accelerating this trend and could even be fueling legislative gridlock.

 

We’ll discuss some proposed solutions with a former top Justice Department official and hear his views on the so-called “deep state,” efforts to prevent political influence at DOJ, and tales from his interactions with former President Donald Trump.
